En r\u00e9sum\u00e9, un travailleur en Isra\u00ebl a droit \u00e0 une indemnit\u00e9 de d\u00e9part apr\u00e8s avoir travaill\u00e9 au m\u00eame poste durant au moins un an, et quand son emploi se termine contre sa volont\u00e9. \u00c0 premi\u00e8re vue, on peut observer que g\u00e9n\u00e9ralement, si un employ\u00e9 a travaill\u00e9 moins d’un an dans la m\u00eame soci\u00e9t\u00e9, et a \u00e9t\u00e9 renvoy\u00e9 avant la fin de l’ann\u00e9e, il n’aura pas droit \u00e0 une indemnisation.<\/p>\n

De m\u00eame, on constate que si l’employ\u00e9 d\u00e9missionne volontairement, il n’aura pas droit \u00e0 une indemnisation, sauf si son contrat de travail en pr\u00e9voit autrement, comme c\u2019est le cas du contrat de type 14 par exemple. Dans tous les cas, l’employ\u00e9 peut pr\u00e9tendre \u00e0 son indemnit\u00e9 de d\u00e9part qui a \u00e9t\u00e9 \u00e9pargn\u00e9e par son r\u00e9gime de retraite.<\/p>\n

Quand l’employeur tente d’exploiter les failles de la Loi<\/h3>\n

Certains employeurs verront dans ce qui est dit plus haut une invitation \u00e0 licencier des employ\u00e9s de bas niveau juste avant la fin de leur premi\u00e8re ann\u00e9e d\u2019emploi. Dans le secteur des services, et ailleurs, on demande parfois \u00e0 tous les employ\u00e9s de service, une fois tous les 10 mois de \u00ab d\u00e9missionner \u00bb et ensuite d’\u00eatre r\u00e9embauch\u00e9. Dans ces cas, l’employ\u00e9 n’aura pas droit automatiquement \u00e0 une indemnit\u00e9 de d\u00e9part, mais le tribunal des Prud\u2019hommes pourra tout \u00e0 fait lui accorder des documents prouvant que l’employ\u00e9 travaillait au m\u00eame endroit pendant plus d’un an (comme des bulletins de paie) et statuer en sa faveur dans une poursuite contre l’employeur. Dans ce cas, l’employ\u00e9 recevra une indemnit\u00e9 de d\u00e9part, et peut-\u00eatre m\u00eame le remboursement des frais de proc\u00e9dure. Cela vaut \u00e9galement pour les travailleurs saisonniers qui ont travaill\u00e9 plus d’un an au total. Dans certains cas, il y aura lieu de proc\u00e9der \u00e0 un recours collectif contre l’employeur.<\/p>\n

En g\u00e9n\u00e9ral, les juges en Isra\u00ebl voient dans le licenciement d’un employ\u00e9 vers la fin de l’ann\u00e9e de travail, la tentative de l’employeur d’\u00e9viter de payer les indemnit\u00e9s de d\u00e9part, et de pouvoir licencier sans avoir \u00e0 donner une raison suffisante.<\/p>\n

Les circonstances de refus de l’indemnit\u00e9 de d\u00e9part \u00e0 un employ\u00e9 qui a \u00e9t\u00e9 cong\u00e9di\u00e9<\/h3>\n

Si dans la convention collective sign\u00e9e par l’employ\u00e9 au moment de son embauche, sont d\u00e9taill\u00e9es les conditions dans lesquelles un employ\u00e9 peut \u00eatre licenci\u00e9 sans indemnit\u00e9s de d\u00e9part, et que l’une de ces conditions est remplie dans sa situation, il ne recevra pas d\u2019indemnit\u00e9s de d\u00e9part. Ces conditions sont g\u00e9n\u00e9ralement les m\u00eames conditions pour lesquelles le Tribunal des Prud\u2019hommes sera en mesure d’accepter la d\u00e9cision d’un employeur de refuser de payer une indemnit\u00e9 de d\u00e9part \u00e0 l’employ\u00e9 licenci\u00e9 qui n’a pas sign\u00e9 la convention collective.<\/p>\n

Ces conditions sont en particulier les dommages caus\u00e9s intentionnellement \u00e0 l’employeur. Il s’agit de bien plus qu’une n\u00e9gligence grave ou qu’un simple manque de capacit\u00e9. Une violation grave de discipline, des dommages physiques caus\u00e9s intentionnellement etou au lieu de travail et\/ou aux mat\u00e9riaux qui y sont pr\u00e9sents, des secrets remis aux concurrents, le travail pour un concurrent, avoir travaill\u00e9 ailleurs pendant les vacancesla maladie, les infractions p\u00e9nales graves, etc. Dans de nombreux cas, en particulier lorsque le licenciement \u00e0 lieu dans ces circonstances, l’obligation de preuves incombe \u00e0 l’employeur, et est plus lourde que dans un cas de droit civil normal.<\/p>\n

Consid\u00e9rations du Tribunal des Prud\u2019hommes sur le refus d’indemnit\u00e9 de d\u00e9part<\/h3>\n

Le juge du Tribunal des Prud\u2019hommes examine dans chaque cas particuli\u00e8rement si l’employeur a le droit de priver ou non l’employ\u00e9 de ses indemnit\u00e9s de cessation d’emploi. Les raisons qu’examine la Cour sont le fonctionnement de travail de l’employ\u00e9, c’est \u00e0 dire, s’il a bien travaill\u00e9, pendant une longue p\u00e9riode, et sans probl\u00e8mes pr\u00e9c\u00e9dents. D’autre part, est pes\u00e9 le montant des dommages \u00e0 l’employeur, le degr\u00e9 de malveillance ou de n\u00e9gligence grave de l’employ\u00e9, etc.<\/p>\n
